Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Aspen Air Conditioning (“Company,” “we,” “us,” or “our”), concerning your access to and use of the aspenairconditioning.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Service.

User Representations

By using the Site, you represent and warrant that:

Services and Pricing

We reserve the right to revise or discontinue any service or pricing at any time without prior notice. All prices for HVAC services are subject to change and are provided as estimates only. Final pricing will be provided in writing before work begins and may vary based on the actual scope of work required.

Service Appointments and Cancellations

When you schedule a service appointment with us, you agree to be present at the service location during the agreed-upon time window. If you need to reschedule or cancel an appointment, please notify us at least 24 hours in advance. Repeated no-shows or late cancellations may result in a cancellation fee.

Payment Terms

Payment is due upon completion of services unless other arrangements have been made in writing. We accept major credit cards, checks, and cash. For larger projects, a deposit may be required before work begins. Late payments may be subject to interest charges and collection fees.

Warranties and Guarantees

We stand behind the quality of our work. Specific warranty terms will be provided in writing for each service or installation. Manufacturer warranties on equipment are separate from our labor warranties and are subject to the manufacturer’s terms and conditions.

Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of your use of the Site or breach of these Terms of Service.

Governing Law

These Terms shall be governed by and defined following the laws of the State of Florida. Aspen Air Conditioning and yourself irrevocably consent that the courts of Palm Beach County, Florida shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

Dispute Resolution

Any dispute arising out of or relating to these Terms of Service or the services provided by Aspen Air Conditioning shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the parties agree to attempt mediation before pursuing any other form of dispute resolution.

Changes to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Service, and you waive any right to receive specific notice of each such change.
